You are registering for an online only auction. By registering you agree to all terms and conditions including those set forth as Broadwell & Associates Auctioneer Terms and Conditions, and all Instructions regarding payment, shipping and removal of goods.
BIDDING TIMES THE MONEY (X2)
Please note some items are times the money. Meaning; if you bid $10.00 on an item that is 2X Money you are bidding $10.00 Each for a total bid of $20.00.
By registering for this auction you are giving permission for Broadwell & Associates to place you on the Auction Update email notification list. You may opt out of this process at anytime by following the directions on the email itself.
All goods are sold AS IS, WHERE IS, without warranty expressed or implied by the seller or auctioneer. The seller has provided descriptions of items for sale that are believed to be correct, however, neither the seller or the auctioneer guarantee the accuracy or correctness of any description. An on-site inspection time will be provided and inspection of goods is recommended by the auctioneer. Your failure to inspect goods before bidding does not relieve you of your responsibility to pay for your purchases as agreed. No claims for refund, price adjustment or withdraw of a bid will be considered. As a bidder you will determine the value, condition, age, authenticity, rarity or construction materials of the goods offered for bid. All transactions are between the seller and the buyer, the auctioneer acts only as an agent.
Consider all computers have been erased. Operating systems may or may not be in working condition.
BIDDING & EXTENDED BIDDING
This is a timed online-only auction. All bids for this auction must be placed online via the internet through our bidding platform. You will place a bid which will be considered your maximum bid. The system will then put your bid at the level required to make you the high bidder. As others bid your bid will be increased in pre-set intervals until you win the bid at the close of the auction or until your maximum bid is exceeded and you are out of the bidding. You may re-enter the bidding at any time you are outbid until bidding has ended on that item. The opening and closing dates and times of the auction are posted at the end of the Terms and Conditions. The auctioneer reserves the right to extend bidding on any item which receives a bid in the final five minutes of the auction. Extended bidding will continue until bidding on that item ceases.
In addition to EXTENDED BIDDING we also will use a staggered closing. For a staggered closing: starting with the first 25 items listed in the auction. 25 items will close each minute. EX: 1-25 Close at 7:00, 26-50 Close at 7:01, 51-75 Close at 7:02 and so on.
EQUIPMENT & SOFTWARE FAILURE
The auctioneer is held harmless for any losses caused by computer, software, hardware or server malfunctions, or down time during this auction event.
PREMIUMS AND TAXES
A Buyer's Premium of 15% will be added to your high bid and will be part of the final selling price. The Buyer's Premium represents the bidder's share of the cost of producing the auction. Seven percent (7%) sales tax will be added to the final invoice of all South Carolina residents. If a bidder has a resale tax number it is the bidder's responsibility to email a valid certificate to firstname.lastname@example.org no later than 1 hour prior to the auction closing time to be exempt from sales tax.
State Sales Tax, Property Tax, State Registration Fees on vehicles will not be charged by the auctioneer and are the responsibility of the buyer to pay the appropriate government agency.
Broadwell & Associates are the acting as agent for the private owner of the firearms being sold. To purchase a firearm the buyer must be (21 yrs) twenty-one years old, a resident of South Carolina, sign the Broadwell & Associates Firearms Transfer Form and have in your possession valid South Carolina Drivers License. Under no circumstances will Broadwell & Associates ship firearms. A buyer requiring shipping must make arrangements with an FFL for that service, otherwise delivery must be taken at the auction site. Condition of firearms is determined by the buyer during the inspection period. No other warranty exists.
Your payment method will be pre-determined when you register. You will pay by credit card; Visa, MasterCard or Discover Card only. Your credit card number will be on file and the full amount of your purchases including the buyer's premium and sales tax, if applicable, will be charged to your account within 30 minutes of the close of the auction. Your acceptance to the Term and Conditions set forth herein includes your agreement not to initiate a chargeback on your credit card. A declined credit card will result in a ($30) thirty dollar processing fee to use a different card or to process a check. A buyer wishing to pay CASH must notify the Auction Company of their intentions 2 hours before the closing day and time of the auction.
PAYMENT FOR TITLED VEHICLES
All titled vehicles must be paid for in CASH or CERTIFIED FUNDS. We do not accept credit card payment on any items that require titles. Titles will be mailed within 10 days of payment or the auction closing.
No goods will be removed from the auction site until paid for in full. The date and time for removing your purchases will be provided at the end of these Terms and Conditions. Small items may be shipped. Request for shipping service must be made in writing via email to email@example.com before pick up day. Charges for packaging, shipping and handling will be charged to the credit card on file. Shipping is not a service provided by Broadwell and Associates, The Eagle Auction Center or Ivan L. Broadwell, Auctioneer; any claims/disputes will be between the carrier (UPS/USPS) and the buyer.
Items not picked up at the auction site during the advertised pickup times will be held 30 days after which those items will be considered abandoned and forfeited. Disposal by discarding, re-sale, or donation will be at the auctioneer's discretion. No refunds, money or receipts for sales or donations will be provided to the buyer. In the case of cost for removal, the buyer will be charged in full for any cost incurred for removal of items not picked up.
If any buyer request a special pick up appointment, there will be a $25.00 per hour (1 hour min.) charge on your credit card per event to cover cost of staffing. If you cannot meet the terms and conditions of this auction please Do Not Bid.
MOVING, DECONSTRUCTION AND UNINSTALLING
Deconstruction of structural purchases including, cabinetry, flooring, framing, sheeting, windows, doors, fireplaces, appliances or any other such purchases are solely the responsibility of the buyer. All labor, loading, equipment, tools or vehicles required to deconstruct will be provided by the buyer. Uninstalling of fixtures, plumbing, electrical appliances, lighting, built-ins, specialty equipment or any other such purchases are the responsibility of the buyer to remove. All labor, loading, equipment, tools, or vehicles required to remove all purchases will be provided by the buyer. The buyer is responsible for safety of personnel used to remove or deconstruct and the safety of others picking up goods in the same area. The buyer will be held responsible for any unnecessary damages done to the property resulting from the removal process. In the event that an item that requires Deconstruction or Uninstalling is not picked up, that item will be forfeited.
